Rules and Regulations

There are two categories for this contest: Open Category and Official Content Provider Category. The specific rules for each category are specified below.

Open Category

The Open Category of this contest is open to individuals and companies developing contents for i-mode services, except for Official Content Providers (as defined below).

Only unpublished and original application will be accepted. Any contest entry (application) that is published or disclosed to any third party, in whole or in part, until the results of this contest will be disqualified. For the purpose of this rule, an application shall be regarded unpublished if such application has not been published under any DoJa environment.

Submission of entry into this contest deems that applicants agree to be bound by the terms of this rule and by the decisions of the Organizer, which are final and binding on all matters pertaining to this contest.

The intellectual property rights to the contest entry (application), if any, will remain with the applicants. As a condition of entry, applicants agree that the Organizer shall have the right to use, copy, modify and make available the contest entry (application) in connection with the operation, conduct, administration, and advertising and promotion of this contest via communication to the public, including, but not limited to the rights to modify the contest entry (application) to the extent necessary to make sure that it properly works with i-mode enabled handsets and to make the contest entry (application) downloadable to the public from the DoJa Developer Network site (which is currently at http://www.DoJa-developer.net/).

Acceptance of the prize constitutes permission for, and winners consent to, the Organizer to use a winner's name and/or likeness and contest entry (application) for advertising and promotional purposes without additional compensation, unless prohibited by law.

Applicants certify that their contest entry (application) is original and that they are the sole and exclusive owner and right holder of the submitted entry and that they have the right to submit the contest entry (application) in this contest. Each applicant agrees not to submit any contest entry (application) that (1) infringes any third party proprietary, intellectual property personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law. To the maximum extent permitted by law, each applicant indemnifies and agrees to keep indemnified the Organizer at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the applicant and/or a breach of any warranty set forth herein.

Applicants agree that this contest and this rule are governed by and shall be construed in accordance with the laws of Japan without regard to its conflict of law rules.

The Organizer of this contest is NTT DoCoMo, Inc., 2-11-1, Nagata-cho, Chiyoda-ku, Tokyo 100-6150 Japan.

Official Content Provider Category

The Official Content Provider Category of this contest is open to companies that, as of the date of its entry to this contest, provide any content for one or more i-mode services as an official content provider (“Official Content Providers").

Only original application that is unpublished as of September 1st, 2006 will be accepted. For the purpose of this rule, an application shall be regarded unpublished if such application has not been published under any DoJa environment.

Submission of entry into this contest deems that applicants agree to be bound by the terms of this rule and by the decisions of the Organizer, which are final and binding on all matters pertaining to this contest.

Upon request by the Organizer, the winner shall make its prize-winning contest entry (application) downloadable from its website and notify theOrganizer of the URL of such website, which will be announced by the Organizer.
